Good Friday...No...GREAT FRIDAY!!!
Hey all!
Some good news to update you about the situation with my nephew Zach. This morning there was another court appearance...this time was the first that anything actually happened. Don't jump out of your seats and expect this to be a movie of the week with a happy ending just yet, but it looks like things are turning around...slowly.
Earlier, the judge asked all the lawyers involved (four including my sister's, one for Zach, one for the Cabinet, and one for Zach's biological father) to file briefs about the case. Three of them were in support of Emily and Kelly getting custody of Zach, of course the other was for the other side. I haven't got a chance to read them yet, but Em says they were all very strong and well written.
This morning, the judge had my brother in law and a social worker (a good one) testify on the stand about financially supporting Zach. I'm not exactly sure why that was an issue, but Em said they had to show all their bills and income and proved that the small stipend from the state was not even half of what it takes to raise a child. Something about de facto custodian...I dunno. All this came as a surprise to Emily and Kelly (and apparently their attorney too), as they didn't know they'd have to provide this information on the spot and that Kelly would take the stand.
Ultimately the judge said I'll make a ruling withing 30 days. In the meantime the Guardian ad Litem (the attorney for Zach) said it's just crazy that Em and Kelly have no visitation, and that he's going to make sure they see him soon. The regional social worker (not the one who testified), said oh I don't know about that, I'll have to ask my supervisor, and the GAL said, go ahead and ask, but I'm filing a motion to grant visitation right now.
Emily sounded great on the phone and very positive...so hopefully it's just a matter of time.
On an unrelated note, I went to "Psycho Cycling Friday" this morning for TWO HOURS. Actually the class just lasted 1:55...I biked 26 miles...that's like a marathon or something. Now my legs feel like jelly.
Alrighty...have a great "Good Friday" and a wonderful weekend.
Don't worry, I'll post again before I leave on Tuesday!
